The Framers of the Bill of Rights did not purport to 'create' rights. Rather they designed the Bill of Rights to prohibit our Government from infringing rights and liberties presumed to be preexisting.
Every science has for its basis a system of principles as fixed and unalterable as those by which the universe is regulated and governed. Man cannot make principles he can only discover them.
